Sexy don-don wants IGP Dampare in court testifying
Daniel Asiedu alias Sexy Don-Don has expressed interest for Inspector General of Police (IGP), Dr. George Akuffo Dampare to be called upon testify in the killing of a law maker, Joseph Boakye Danquah Adu also known as JB.
The accused killer of the late Member of Parliament (MP) for Abuakwa North in the Eastern Region, made the application based on inability of the case investigator, Assistant Superintendent of Police (rtd) Daniel Nkrumah to answer some specific questions posed to him.
Daniel Yaw Dankwa, counsel for requested that Dr Dampare who at the time of the MP’s in 2016 at his private residence at East Legion, was the Accra regional commander, took his tend to mount the witness box.
Further Cross-Examination Q: You being a very experienced investigator, when those names were not given to you, you did not care to find out the names of those individual police officers who went to the scene crime?
A: Per our investigations, it came to our notice that the regional commander by then, who is now the present IGP, was present at the scene. Furthermore, I have indicated in this room that it was an investigation team and I…
Q: You were so empathetic when you told the court that you are the lead investigator and the recorder of the team, has that story changed?
A: That story has not changed, I told this court that the team has a leader, and I even mentioned the name in this court, but I never mentioned that I am the leader of the team.
Q: Until your team leader tells you to find out the name of the officers who were at the crime scene, you did not deem it necessary that those whose who part of the investigation?
A: I have stated in this room, that is was a team work.
Q: You said that the IGP who was then the regional commander was at the crime scene, if he was sitting in your place, would he be able to recollect the names of the officers at the scene?
Prosecution: I object to this question and my objection is that the witness is been asked to speak on behalf of someone who is not in the chair. He is in not the position to say what the person will say.The witness cannot be asked to speculate, he can only speak to what he knows based on personal knowledge. I pray that this question is disallowed.
Counsel: The objection is baseless and it is without foundation and at best, just to derail the flow of my cross examination. The withess has told this court and the jurors that they work in a team and there is a procedural and the IGP is part in the team and in fact, he was the first person who dealt with the incident. From the witness own mouth it was the IGP and the regional minister…it was a matter of fact, the IGP, the then regional commander who first delved into the investigation and my question is not seeking a personal thought but procedural
.Judge: By Court…
Q. You will agree with me that since IGP is part of the whole investigation, his presence in this court will help this jurors and the court established what happened on that day?
A. I will say IGP was not part of the investigating team. The fact of this case per our investigation was established with or without the IGP. The first accused himself confessed to the crime and per our investigation he was taken to the crime scene himself on his own volution demonstrated to the investigating team on how he managed to perpetrated the crime. In the deceased room he himself prayed for forgiveness on what he had done. Exhibits that were filed in this room, he admitted sending them there. I don’t know what counsel is trying to tell this court.
Q. You being a very experienced investigator, do you know that if the accused said he killed the man, you still have to prove his guilt by the evidence that you have and not what he has said?
A. That’s exactly what the investigation revealed.Q. How many police officers went to the scene of the crime when the incident?
A. I can’t tell Q. Could it be three?A. I can’t tell Q. Could it be two?
A. I can’t tell
Q.If you cannot tell, then you cannot tell this court that there were police officers taken to the scene A.
Q. It is true that every police officer who they report on night duties are to sign a lodge book of their presence?
A. That’s true Q. It is also true that if you are not the investigator but you are sent on an assignment especially on patrol to Withess a dead body you do entry in your action diary on what you saw on that day. Correct?
A. When the patrol team went there they were joined by other people and after they have conducted a search and inspected the scene, the investigators took over the case.
A. He told this court that, there were only three police officers who he escorted to the house and not what you are saying.
A: It’s a lie. It is set up. A plot. It’s a fabricated story to give a cover up of the true perpetrator?
A cover up of the person who killed JB. That’s not true. The killer is the first accused.
Q. I’m further suggesting to you that the so called police officers (Apraku mentioned about) for which you not being present having no record confirming to this court were those who killed JB Danquah and after killing him disappeared into thin air and somebody’s somewhere crafted this story and you did not see it?
A. That’s not so. I want to court to know that the first accused after perpetrating the crime left his T-shirt that he wore that night before the crime which the investigating team found in deceased room soaked with blood, this T-shirt was identified by the first accused girlfriend who is Janet Tsirah (Kyirah) after which the accused himself identified the same T-shirt as belonging to him. Aside that, handkerchief soaked with blood which was also found at the scene of crime was identified by first accused girlfriend and he himself as his. His slippers found…that the accused admitted is his. A cutter and a caterpult were also found in deceased room, which the acccused person admitted he had carried them there. During investigation, the knife that the first accused person used, in stabbing the deceased to death was also traced to the accused took at Agbogloshie which the accused girlfriend admitted that the first accused brought that knife with blood stains on it and asked her to clean it.The accused person himself when the knife was shown to him admitted he had used that knife on the deceased persons and stated that he was held by the deceased and in an attempt to free himself killed him. This the accused person himself admitted so I don’t know where counsel is getting his information from.
Q. You in your long answer have indicated that the accused girlfriend handed over a crucial evidence to the team. You said accused girlfriend identified T-shirt correct?
A. Yes
Q. And you also said that the knife was given to accused girlfriend to clean correct?
A. Yes
Q. And you also went to accused room at Agbogloshie and you found something?
A. That’s so. It was a knife he used in killing the deceased.
Q. You will agree with me that if what you saying is true the accused dwelling become a crime scene that?
A. Yes
