Adamus Resources Management stincks -LMWG
The Lands and Mining Watch Ghana (LMWG), a civil society organization, has estimated that the country has lost over US$7 million, due to gross disrespect to the Interim Management Committee (IMC), established on the orders of the Accra High Court.
LMWG is of the view this revenue loss is a result of illegal exportation of gold from Adamus Resources without recourse to the the High Court ruling, dated July 27, 2023.
Solomon Owusu, Convener of LMWG, indicated that a press conference in Accra on Wednesday, the order was made by a court of competent jurisdiction and ought to be respected.According to him, lawyers of the IMC issued a statement in respect of the court order not being followed.
“The contempt displayed by Angela List and her cohorts towards the clear directives of the Accra High Court regarding the constitution of an Interim Management Committee (IMC) for Adamus Resources is deeply troubling.
Despite the court’s unambiguous instructions, our investigation has uncovered no evidence of an appeal lodged against these orders. This blatant disregard for the rule of law and the judiciary’s authority is unacceptable and demands immediate redress,” he said.
The LMWG Convener added the Government has a responsibility to fulfill its duty to protect its interests, particularly its substantial 10% stake in Adamus Resources.
To him, the government is not doing much to protect the interest of the country, hence revenue being lost to illegal shipment of gold from its shores.
Mr. Owusu urged the media, civil society organizations, and all stakeholders to unite in demanding accountability and transparency from the government.
The orders The court restricted Nguvu Mining Limited Directors from taking any steps to hold any meeting for and on behalf of Adamus Resources, shareholders.
The court further restrained Angela List, Joseph Owusu-Ansah and Dr. Anthony Aubynn from holding themselves out as Directors of the Adamus Resources until the final determination of the suit.
Odame Sarpong was also restrained from holding himself out as Secretary of the Adamus Resources.
Nguvu Mining Limited and its Directors are restrained from taking any steps pursuant to any Share Transfer Agreement signed by Moses Kobina Bosompem or whosoever on behalf of the Nguvu Mining Limited and by Angela List for and on behalf Nguvu Mining Limited to make the the controller of the Adamus Resources PTY Ltd from taking any decision in respect of Adamus Resources Ltd.
Allan Morrison, the first defendant/ applicant in the suit, filed the motion on March 30, 2023, to seeking nine restraining orders against the respondents /plaintiffs.
In pursuant to the restraining orders, the Court presided over by Justice Jane Harriet Akweley, rules that a five-member interim Management Committee (IMC) to manage to manage the affairs of the Adamus Resources Ltd.
Per the orders, each party shall provide two representative on the IMC, which same would have a representative from the Ministry of Lands and Natural Resources, while it barred the restrained persons from representation.
The Management Staff of Adamus Resources Ltd were also ordered to report daily to the Chairmen of the IMC and shall take instruction trom the IMC and any subcommittees that the IMC shall dem appropriate to further the progress and good corporate governance of the company
