He was remanded yesterday by the Circuit Court ‘3’ presided over by Her Honour Susana Ekuful.

Villey has pleaded not guilty to discharging guns in town and issuing threat of death to the dispute party, Solomon Akwabi.

Facts of the case:

The Prosecuting Officer, Assistant Superintendent of Police (ASP) Evans Kesse told the court that for some time now Solomon and Villey are contending over the ownership of a six bedroom uncompleted.

He said although the building was put up by Villey, but has allegedly been sold same to Solomon.

According to the prosecutor, the contention over the said building at Baatsona is still pending before the  same court.

ASP Kesse narrated to the court that on May 29, 2022, the complainant and a witness in this case visited the  said building site and met the accused person.

He said without any provocation, the accused person pulled a pistol at the complainant and threatened to kill him.

The prosecutor said the Villey fired two warning shots in the presence of witness and both Solomon and his witness rushed to the police station to lodge a complaint.

ASP Kesse added that investigation conducted at the scene as well as interviews, confirmed that the Villey indeed threatened to kill the complainant with pistol after firing the two warning shots.

He informed the court that police investigation led to the retrieval of 40mm Caliber pistol marked SMITH WESSON – HTU 5617-AA4/9034/16 with nine rounds of ammunition from the accused person.

The prosecutor added that the accused person was then arrested but denied any wrong doing in his cautioned statement.

The genesis of the dispute

It was said during the month of February 2020, the Villey advertised his six-bedroom uncompleted house at Bastsona – Spintex for sale through an Estate Agent, Kwadwo Owusu.

Solomon together with the agent met Villey and they all agreed at a price of GH¢820,000.00 for the building.

Mr Akwabi made payments to Villey in a total sum GH¢700,000. OO through the witness and receipts were issued to that effect.

However, when Solomon demanded for documents covering the said building before he pays the balance of GH¢120,000, the accused person sent him a text message that he has sold the same building to another buyer.

Mr Kwabi demanded refund of his money but the accused failed abysmally, hence petitioned the Director-General of Criminal Investigation Department (CID) on October 27, 2022.

On November 2, 2021, the accused was arrested and in his investigation caution statement, he stated that he borrowed the GH¢700,000,00 from the complainant and not that he sold his building to him.

Villey was shown receipt of payments as well as the messages sent to Solomon but he could not give any tangible answer to support his claim.

When the police asked the accused person to produce the original copy of the documents of the said building but he could not.

The court was told that investigations at the Land Commission revealed that, the said land is registered in the name of one Kwadwo Adjei, the same person who issued the indenture to Villey.

It also discovered that Villey has used the same  building land certificate to secure loans from the DCI Microfinance Limited.

The court has adjourned the case to July 11, 2022
