Prosecution closes its case on Capital boss, 3 others

The state has closed its case against the former Chief Executive Officer of collapsed Capital Bank, William Ato Essien Tetteh Nettey, Fitzgerald Odonkor and Kate Quartey-Papafio standing trial for stealing and 25 other counts.    

This was made known to the Financial High Court by the Chief State Attorney Maria Appiah-Opare after Mr Addo Atuah defence lawyer for Mr Nettey concluded his cross examination of the 17 prosecution witness (PW17), Chief Superintendent Joseph Oppong on Thursday, April 22, 2021.

Although on a normal circumstances, the court may order the accused persons to open their defence, the presiding judge, Justice Eric Kyei Baffour was prayed by Miracle Attachey, Counsel for Fitzgerald Odonkor, that second prosecution witness Michael Kwame Amoake Atuobi should be recalled, for some document provided by Bank of Ghana to be tender through him. 

 The court heard the prayer and said “Exercising my discretion according to law under section 79 of the Evidence Act, 1975 (NRCD 323), I accede to the request for the witness, PW2 to be recalled, for Counsel for 3rd Accused to tender through him, the statement which was furnished him, and for Counsel for 3rd Accused to further cross-examine PW2 on that statement alone.”

The case has been adjourned to the 29th of April, 2021 for the recall of PW2.
