Ofosu-Ampofo wants stay in high court

Samuel Ofosu-Ampofo has applied for stay of proceedings at the Court of Appeal pending an application for reconsideration of a ruling of the High Court on submission of no case to answer.

Although the defeated National Chairman of the National Democratic Congress (NDC), Mr Ofosu-Ampofo filed the appeal at the appellant court, trial high court is yet to receive a copy.

The high court, presided over by Justice Samuel Asiedu, indicated that despite Tony Lithur, counsel for Mr Ofosu-Ampofo, claiming such an application has been filed it has not been copied.

Yvonne Attakora Obuobisa, Director of Public Prosecutions (DPP), also told the court that they have not been served with copies of the stay of proceedings filed at the Court of Appeal.

Meanwhile, Mr Lithur said the application was filed last week Friday, hoping to bar Mr Ofosu-Ampofo from opening his defence yesterday.

The counsel partially succeeded as the court adjourned sitting to June 1, 2023, leaving the former NDC national chairman not opening his defence.

Dr Aziz Bamba, counsel for the second accused in the trial, Anthony Kwaku Boahen, a member of the NDC communication team, has also indicated that they have filed a fiat and was not surprised the prosecution had not been served.

The two accused persons were arraigned in 2019 after a leaked audio tape went viral where they were alleged to have outlined some activities aimed at causing mayhem.

Mr Ofosu-Ampofo and Mr Boahen have been charged for threatening to cause harm to public officers.
