Man, 26, has pleaded guilty to indecently assaulting a 10-year old girl, on a claim he thought the minor was 18.

An Accra juvenile court, presided over by Her Honour Christina Cann, has sentenced him to 36 months imprisonment on his own plea.

The convict, Emmanuel Mbachu and a Nigerian, was given the sentence yesterday. He was, however, acquitted and discharged on the 2nd count, defilement.

The was told by the prosecution that convict was reported to the police by the girl’s uncle who chanced on the incident, after having gone to visit his niece father.

It was said that the complaianant is a businessman and resident of Accra and lives in the same vicinity with the convict, his brother and niece. But the complainant’s brother and his daughter live in the same compound with the convict.

on January 29, 2023 at about 10:00am, the complainant who is the victim’s uncle came to visit her father but the later was not present.

The court heard that while the complainant was still waiting, the victim’s father called him to check on the victim.

The complainant then asked the children playing in the house the whereabouts of the victim and they told him they saw her entering convict’s room.

The complainant then went to knock at the convict’s door but there was no response but after persistent knocking, the latter opened the door.

When the complainant asked of the victim what she went to do in the convict’s room, she responded that the convict invited her.

However, the minor added that while she was in the room, the convict started fondling her breast and also asked her to suck his sexual organ, which she did.
The victim further stated that she later laid on the convict and he inserted his penis into her. 

The complainant immediately arrested the convict to the Korle-Bu Police Station and lodged a complaint.
Extract was prepared and forwarded to Mamprobi Domestic Victim, Violence and Support Unit (Dovvsu) for further investigations. 

Police medical report form was issued to the complainant to send the victim to the hospital for examination, treatment and report,which was done.
 Investigation caution statement was obtained from the accused person and after investigations, and the convict was charged with the offences before the honorable court.
