Judge question suggests Jean Mensa can’t to be trusted – Kpessa Whyte
Dr Kpessa Whyte has told a Supreme Court justice who asked why he together with the other acted on the instructions of the Electoral Commission (EC) chairperson and vacated their duty post, that the question only to suggests that the EC boss was not to be trusted.
The justice of the seven-panel member panel hearing the 2020 presidential election petitioner, sought to find out why the agents of the petitioner, Dr Whyte and Rojo Mettle choose to act on order on the EC’s instruction instead of staying their duty at the Commission’s strong room.
This was as Dr Whyte had testified before the court presided by the Chief Justice Anin Yeboah that the EC’s Chairperson, Jean Mensa made the declaration of the presidential elections after she had a conversation with his colleague that they should send a message to the petitioner about some irregularities they had identified about the results.
He shortly after they left, Mrs Jean Mensa organised those present and announced the outcome of the presidential results at the Headquarters of the Commission against her earlier communication to the various parties that the exercise will be conducted at the International Conference Centre.
However, the judge insisted that their decision to respect the orders of Mrs Mensa at that critical moment was a great disservice to the petitioner and the party they were representing.
Dr Whyte further told the court when being cross examined by the counsel of the EC, Justine Amenuwo today because they were only acting on her instruction to fix a problem they identified with the figures from the regions that were coming, they left their working tools in the EC’s strong room.
However, the EC lawyer denied any such incident happened and that the two gentlemen evaporated into the tin air after realising their candidate had lost the election.
But, Dr Whyte declined the assertion to state that if that had been the case, they would have left with their working gargets, specifically their laptops and all their vehicles but they returned about 45 minutes to find the strong room empty.
Also using an opportunity that another judge attempted to solicit information from whether he can identify a controversial ‘Form 13’, they allegedly failed to sign, to say it was a wrong impression being created the EC because the document that was shown is not the said, since it lacks certain features.
The other members of the panel are Justice Yaw Apau, Samuel Kofi Marful-Sau, Prof. Nii Ashie Kotey, Nene A. O. Amegatcher, Gertrude Torkonoo and Mariama Owusu.
